IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 3080/2018 SHIV SHANKAR & ORS ..... Petitioners Through:

Mr. Harish Kumar, Adv.

versus STATE (GOVT OF NCT OF DELHI) & ANR ..... Respondents Through:

Mr. M.S. Oberoi, APP for State with ASI Satyawan, P.S. Bindapur.

Respondent nos. 2 and 3 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 30.05.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent nos.2 and 3 are present in Court and accept notice. They have been identified by ASI Satyawan of police station Bindapur. Respondent nos.2 and3 submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, therefore, they do not wish to pursue the FIR No. 947/2015 under Sections 354B/323/427/34 IPC registered at police station Binda Pur and the same may be quashed.

Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the

interest of justice, aforesaid FIR and the consequent proceeding emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
