% 09.08.2016 Crl.M.A. 11771/2016 This is an application filed by pairokar of the petitioner who happens to be his sister seeking withdrawal of BAIL APPLN.1013/2016. When the application came up on 3rd August, 2016 neither the pairokar was present nor the counsel was present and this Court noted that the signatures on the main petition were different from the signatures in the application seeking withdrawal. Thus this Court directed production of the petitioner from jail for today.

Petitioner is present in Court. He states that he had instructed his lawyer Shri J.P. Singh who is running the firm in the name of 'J. P. & Associates B-6/175, Sector-8, Rohini, Delhi' with mobile No.9911063933 to

file the application for bail before the learned Trial Court and not this Court. On being asked, Sangeeta, sister of Ravinder states that she had filed the application for withdrawal because her brother wanted to take the chance for applying before the learned Trial Court. She further states that she had signed this application which is Crl.M.A.11771/2016 but she did not sign the affidavits filed along with the bail application. She states that she has never signed in English and her signatures are in Hindi. In view of the statement of the petitioner and the sister of the petitioner this Court permits the petitioner to withdraw the Bail Application. Crl.M.A.11771/2016 is disposed of.

Bail application is dismissed as withdrawn with liberty to the petitioner to raise the pleas taken herein and fresh pleas before the learned Trial Court in the bail application he proposes to file. However, in view of the statement of Ms. Sangeeta and the signatures of parokar Sangeeta on the affidavits with the main petition and exemption application, notice be issued to Mr. J.P. Singh, Advocate Enrolment No.D482/2000 by Registry at the above-noted address to be present in Court on 30th August, 2016.

Mr. J.P. Singh be also informed telephonically by Registry about the next date fixed before this Court on the phone number noted above. Ms. Sangeeta is also requested to be present on the next date of hearing i.e. 30th August, 2016.
