% 16.04.2025 EX.APPL.(OS) 640/2025 1.

This is an application seeking additional period of 6 weeks to deposit the amount in terms of the orders dated 09.08.2024, 16.01.2025 and 28.02.2025 passed by this Court.

As per the Arbitral Award, the judgment-debtor was to make payment(s) of the balance decretal amount to the decree holder. 3.

In the present case, vide judgment dated 09.08.2024, the judgment-debtor was required to deposit the awarded amount in terms of the Arbitral Award dated 16.08.2017. Thereafter, the computation of the decretal amount was finalized by the learned Joint Registrar. 4.

On 28.02.2025, the judgment-debtor was granteda period of 6 weeks as last and final opportunity to deposit the requisite amount. Despite the extensions, the amount has not been deposited and the present application has been filed seeking another extension of 6 weeks on the ground that a board meeting is required to release such an amount and due to unforeseen circumstances, the same could not be held. 6.

I am of the view that the timelines granted by the Court are to be followed both in letter and spirit and once last and final extension was granted by the court on 28.02.2025, it was for the judgment-debtor to organize itself to meet the deadlines.

For the said reasons, as last and final opportunity, 10 days are granted to the judgment-debtor to make the payment, failing which the account as well as the inventory of the judgment-debtor shall be attached. 8.
