The present appeal has been filed by the State under Section 378 of the Code of Criminal Procedure, 1973 inter alia, assailing the impugned judgment dated 31st March, 2011 passed by ASJ-VI(Outer), Rohini Courts, Delhi in Sessions Case No. 86/10 arising out of FIR No. 1475/05 registered at P.S. Sultanpuri, for offences punishable under Sections 302/34 of the Indian Penal Code, 1860.

Vide the impugned judgement, the accused persons, who are Respondent No.1-Ishu and Respondent No.2-Vikram herein, have been acquitted by the Trial Court. The Trial Court came to the conclusion that the prosecution failed to bring home the guilt of the accused beyond reasonable doubt and, therefore, a judgment of acquittal was passed. 4.

Vide order dated 24th February, 2026, it has been recorded that the Joint Registrar had perused the death certificates of the Respondents and had recorded the verification of the death of the Respondents. Respondent No.1 is stated to have expired on 1st June, 2022 and Respondent No.2 expired on 28th December, 2021.

In this view of the matter, since there are only two Respondents in the present case, the appeal abates and is, accordingly, disposed of. No further orders are called for in this matter.
