On the last date of hearing, learned counsel for the appellant was requested to address the Court on the maintainability of the present appeal against an order passed by the Company Judge on an appeal preferred by the appellant under Section 10F of the Companies Act, 1956. 2.

Today, learned counsel for the appellant states that the present appeal would not be maintainable before the Division Bench and he seeks leave to withdraw same, while reserving the right of the appellant to seek legal recourse against the impugned order dated 23.11.2017 before the appropriate forum.
