% 18.10.2016 Learned senior counsel appearing for the petitioner submits that his client is not averse to leading evidence before the ARC but only fears that the respondents being in possession would prolong the litigation needlessly by seeking adjournments.

Learned counsel senior counsel appearing for the respondents has denied that the respondents would be seeking unnecessary adjournments to prolong the matter.

In view of the above, learned senior counsel appearing for the petitioner on instructions submits that without prejudice to his client rights and contentions, he may be permitted to withdraw the present petition. Accordingly the petition and pending application are dismissed as withdrawn.

The ARC is requested to expeditiously deal with the matter. Ordinarily, unless grave circumstances exist, no adjournment would be granted on the request of either side on the dates to be fixed by the ARC for leading evidence/arguments.
