TR.P.(C) 24/2016 This is a petition filed by the petitioners seeking transfer of civil suit no.19/2016 pending before Sh. Prashant Kumar, ADJ, Rohini Courts, Delhi. It is noted that suit bearing CS (OS) no.234/2014 which was filed by the petitioners in this Court, was transferred by the Ld. Joint Registrar on 2nd December, 2015. Later on, it transpired that in view of the notification dated 28th April, 2016 on which reliance has been placed before the learned

counsel for the petitioners, all suits and applications which have been transferred need to be recalled for being heard and disposed of by the Commercial Division of Delhi High Court. The said circular also states that parties to such suits or applications may also approach the concerned District Courts for sending such suits or applications to Delhi High Court for disposal by the Commercial Division of Delhi High Court. In view of the above, the learned counsel for the petitioners states that he would make a request to the concerned District Court for re-transferring the matter to this Court as according to him the suit was pending in this Court on 26th October, 2015 and has been transferred to the concerned District Court only on 2nd December, 2015.

Noting the aforesaid submission of the learned counsel for the petitioners, the petition is disposed of.
