This order is in continuation of the order dated 11th May, 2016, on which date, learned counsel for the petitioner had stated that having regard to the Circular dated 16.01.1993, the respondents ought to have made an effort to accommodate the petitioner at a posting closer to NCT Delhi, having regard to the fact that both his wife and daughter are HIV positive patients.

Learned counsel for the respondents states on instructions that there is a vacancy for the post of Head Constable (GD) at Jammu where Government Hospitals with adequate medical facilities and Super Speciality Hospitals are available.

Learned counsel for the petitioner states on instructions from the W.P.(C) 4199/2016

petitioner that he is willing to accept the posting at Jammu. 4.

In view of the said submission, the impugned Movement Order dated 01.04.2016 is quashed and set aside and the respondents are directed to issue a fresh Movement Order, posting the petitioner to Jammu.

This petition is disposed of along with pending application. 6.
