% 16.04.2018 This petition was entertained in the context of the civil case (ML no. 03/2016) of the petitioner pending before the designated Waqf Tribunal at New Delhi primarily for the relief of injunction, the presiding judge having expressed inability as on 14.03.2016 to grant any ad interim protection, for the reason the powers of Waqf Tribunal had till then not been notified. While entertaining the petition by order dated 13.05.2016 and issuing notice to the respondent it was directed that no coercive steps would be taken by them till 15.07.2016. The said interim order has continued till date. The learned counsel on both sides jointly point out that the Waqf Tribunal is now functional at Patiala House Courts Complex, New Delhi, it having been notified by the Government recently.

In this view, these proceedings are drawn to close. The parties are directed to appear before Delhi Waqf Tribunal on 17th May, 2018.
The interim protection shall continue to inure to the benefit of the petitioner till Waqf Tribunal takes a decision on the pending application for ad interim relief.
The petition and the application filed therewith stand disposed of in above terms.
