% 09.08.2016 Present FIR under Sections 420/467/471 IPC was registered at police station Ghazi Pur on the complaint of employer of petitioner, that is, Ryan International School, Sector-B, Kondli Gharouli Complex, Mayur Vihar Phase-III, Trans-Yamuna, Delhi. It is alleged in the FIR that petitioner had submitted the forged and fabricated 12th class mark sheet of her Senior Secondary School, according to which date of birth of petitioner was 4th September, 1966. This created a suspicion as it was highly improbable for petitioner to complete 12th class at the age of 14. The matter was enquired from the principal of B N Rastogi Girls Senior Secondary School, Bhagirath Palace, Chandni Chowk, Delhi and Miranada College, University of Delhi
as well to verify the correctness of date of birth of petitioner, as contained in the certificate. Both, that is, the school and college verified the date of birth of petitioner to be 13th September, 1962.
Learned counsel for petitioner submits that a departmental enquiry was held and enquiry officer held that employer had failed to prove that provisional certificate dated 4th June, 1980 (Ex.DW-1/2) was a forged document. Learned counsel for petitioner further submitted that even as per the date of birth as propounded by the prosecution, petitioner is about 50 years of age. She has cooperated in the investigation and provided all the document. She is not required for any further investigation. Keeping in mind the totality of the circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail, subject to her furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO concerned.
