% 06.03.2019 After some arguments, learned counsel for plaintiff wishes to withdraw the present suit with liberty to file an appropriate proceeding against AICL.
With the aforesaid liberty, present suit and pending applications are dismissed as withdrawn.
Plaintiff is also given liberty to file an application under Section 14 of the Limitation Act. Needless to say, the said application would be considered on its own merits by the Court/Forum before whom the appropriate proceeding is filed by the plaintiff. It is clarified that the rights and contentions of all parties are left open.
Registry of this Court is directed to issue to an authorised representative of the plaintiff a certificate authorizing him/her to receive back from the Collector full amount of the Court fee paid by it in the present suit.
