After substantial hearing, the appellant present in court along with his counsel seeks permission to withdraw the appeal. 2.

The appeal and C.M.No. 23948/2016 are dismissed as withdrawn. 3.

The interim order dated 27th July, 2016 is vacated. 4.

The Trial Court Record be returned back forthwith. 5.

Learned counsel for the parties submit that the proceedings before the Trial Court are listed on 4th September, 2017 for hearing on the application of respondent No.2 under Order 7 Rule 11 of Code of Civil Procedure. Learned counsel for both the parties submit that they shall not seek any FAO 291/2016

adjournment from the Trial Court on the date fixed. Statement of learned counsel for both the parties is taken on record. In view of the statement made, the Trial Court shall proceed to hear the application under Order 7 Rule 11 of Code of Civil Procedure on the date fixed. 6.
