% 13.05.2016 Learned counsel for the petitioner is aggrieved only to the limited extent that his application filed under Order 9 Rule 13 of the CPC is pending before the ARC since 25.01.2006; since the last one decade, there has been little progress in the matter and inspite of his having moved the application seeking preponement of date of hearing, the same stood dismissed. Submission being that the matter be expedited which will be in the interest of both the parties. Record shows that the next date fixed before the ARC is 25.05.2016. Record further shows that an ex-parte decree had been passed in favour of the non-applicant and against the petitioner under Section 14 (1)(e) of the DRCA on 03.03.2005 pursuant thereto the present application under Order 9 Rule 13 of the CPC came to be filed by the petitioner which is now pending disposal. The Trial Court/ARC shall endeavour that that application is

disposed of expeditiously and preferably within 8 months from the date of receipt of this order.

With these directions, petition disposed of.
