O R D E R

% 30.05.2016 C.M.No.21545/2016 Present application has been filed for correction of typographical error in the order dated 17th May, 2016. Keeping in view the averments in the application, the same is allowed and the order dated 17th May, 2016 shall now read as under:- "Present writ petition has been filed challenging the order dated 31st October, 2015 whereby the petitioner's request for renewal of enlistment was rejected by the respondents on the ground that there were outstanding recoveries against the petitioner.

It is pertinent to mention that petitioner's earlier contract with respondent was cancelled by the respondents and the petitioner-firm was blacklisted. A writ petition challenging the blacklisting order as well as the arbitration proceedings initiated by the respondents for recovery of outstanding dues are pending. Learned counsel for petitioner states that petitioner is willing to deposit the outstanding dues

amounting to Rs.13.5 lakhs in an FDR, provided petitioner's enlistment is renewed.

A perusal of the paper book reveals that the petitioner has filed two appeals challenging the impugned order dated 31st October, 2015.

Consequently, the present writ petition is disposed of with a direction to respondent no. 2 to decide the petitioner's appeals as expeditiously as possible, preferably within a period of two weeks. Petitioner's offer to deposit the money in FDR shall also be considered by the appellate authority. This Court however clarifies that it has not expressed any opinion on the merits of the controversy. The rights and contentions of all the parties are left open.
