% 04.11.2016 EA.(OS)651/2016 By the present application, the applicant Rajinder Prashad seeks a direction to judgment debtor no.2 Gopal Singh Nim to construct a wall from the side of House No.6601. Judgment debtor no.2 Shri Gopal Singh Nim is present in Court and he has no objection to the prayer made which is in continuation of the order dated 16.09.2016.

The second prayer made in this application is a direction to judgment debtor no.2 Shri Gopal Singh Nim and judgment debtor no.5 Smt. Sunita Devi to construct their respective walls in between the share of judgment debtors no.2 and 5 in terms of prayer (B) of the application. Both judgment debtors no.2 and 5 have no objection to the same. Additionally, judgment debtor no.2 submits that he will be constructing the wall from the rear end of the neighbour's wall and not from the out pit of the area of the decree holder.

Both the parties undertake to carry out the construction of the walls in a peaceful manner and without causing any obstruction within three weeks from today. Any violation would be viewed seriously by the Court. It is also agreed that the decree holder will open the door of the subject property within two days from today to ensure parties to have access to their respective portion.

The application stands disposed of.

E.A.(OS).83/2016 The application is dismissed as not pressed.

Ex.P.239/2013 Counsel for the parties submit that no further orders are called for and the execution petition be disposed of as satisfied. The petition stands disposed of accordingly.
