The present appeal under Section 96 of the CPC seeks the following prayers:- "It is, therefore, prayed that the appeal of the appellant be please accepted, set aside the impugned judgment and decree of the trial court dated 17.7.2007, and decree the suit of the appellant against the respondent to the tune of Rs.14,52,185/- along with interest pendentelite at the rate of 2% p.m. w.e.f. 2.3.20003 onwards till realization of the decreetal amount, and the suit of the appellant be please decreed as prayed for.
Any other relief or order that this honorable court deems fit and proper be also granted to the appellant against respondent." 3.
Court notice was issued to the parties vide orders dated 10.12.2024 and 15.05.2025 by the learned Predecessor Benches of this Court, and reports with regard to the same reflect that the parties had been served. 4.
