O R D E R

% 06.08.2018 On the basis of the evidence that had been gathered during investigation into FIR 679/2017 of police station Punjabi Bagh, prosecution has been launched by submission of charge-sheet seeking trial of the petitioner for offences under Sections 376, 506 IPC. The case is pending trial in the court of Sessions, it having been committed by the court of cognizance. On the basis of consideration of the evidence, the trial court has also found charge made out for putting the petitioner on trial for the aforesaid offences, the case being at the stage of prosecution evidence.

As per the allegations in the case, the petitioner had subjected the prosecutrix to sexual intercourse without her consent and she having been subjected to criminal intimidation anterior thereto.

Having regard to these facts and the fact that the prosecutrix is BAIL APPLN. 1321/2018

yet to be examined, this court endorses the view taken by the court of Sessions in declining the prayer for release on bail. Dismissed.
