CM APPL.28970/2018 (Early Hearing) The present application under Section 151 of the Code of Civil Procedure, 1908 instituted on behalf of the applicant/petitioner seeks advancement of the date of hearing.

CONT.CAS(C) 431/2018 Mr. Rakesh Kumar, learned Central Government Standing Counsel appearing on behalf of respondent Nos.4,5 and 6 has placed on record an order dated 07.08.2018, passed by the Principal Director, Defence Estates, Western Command, Chandigarh Camp, Delhi Cantt., as a nominee to the Defence Secretary.

The order complies with the directions issued by this Court on 03.09.2017, albeit belatedly to decide the petitioner's representation dated 22.04.2017, seeking removal of respondent No.2 as a Member of the Delhi Cantonment Board, in terms of Sections 34(1)(e) and 34(2) of the Cantonments Act, 2006.

Admittedly, the said order dated 07.08.2018 has been rendered after affording an opportunity of hearing to the petitioner, as well as, respondent No.2.

Learned counsel appearing on behalf of the petitioner states that she is aggrieved by the said order dated 07.08.2018 and, therefore, seeks leave to withdraw this petition with liberty to assail the same, in accordance with law, in an appropriate proceeding.

Leave and liberty granted.
