% 29.11.2016 By this petition, the petitioner seeks quashing of FIR No.1217/2014 under Section 135 of Indian Electricity Act, 2003 registered at PS Amar Colony on the complaint of respondent No.2 and proceedings pursuant thereto as parties have settled the matter and entire dues towards respondent No.2 have been paid.
Ms. Jaya Thakuria, Sr. Manager(Legal) and authorised representative of respondent is present in Court and identified by learned counsel. She states that she is authorised and competent to make statement on behalf of respondent No.2. She states that the petitioner has paid the entire theft bill amounting to ₹22778.53p and thus respondent No.2 does not wish to pursue the above noted FIR and proceedings pursuant thereto.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No.1217/2014 under Section 135 of Indian Electricity Act, 2003 registered at PS Amar Colony, Delhi and proceedings pursuant thereto are hereby quashed.
Ms. Jaya Thakuria has signed this order sheet in acknowledgment of her statement made before this Court.
