% 27.09.2016 Learned counsel for petitioner states that he has instructions to withdraw the present writ petition. He further states that the excess payment of Rs.83,813/- shall be paid to the respondent within a period of four weeks along with simple interest @ 6% per annum from the date the respondent had deposited the amount i.e. 10th November, 2003 till the date of repayment. The statement made by learned counsel for petitioner is accepted by this Court and petitioner is held bound by the same. In view thereof, present writ petition and applications are disposed of. However, the issue of interpretation of Regulation 7(3) of DERC Regulations 2007 is left open.
