O R D E R

% 27.07.2018 By this petition the petitioner seeks parole on the ground that his wife is unwell. When the matter came up before this Court on the last date of hearing i.e. 17th July, 2018 learned counsel for the petitioner informed that father of the petitioner had passed away on 9th June, 2018 and he was required to perform the last rites. Learned counsel for the petitioner fairly submits that though cremation of his father has been done but other rituals are still required to be performed.

A Status Report has been handed over in Court, which is taken on record. As per the Status Report, though wife of the petitioner was not found suffering from any serious ailment however, the factum of the death of the father of the petitioner on 9th June, 2018 at Delhi State Cancer Institute GTB Hospital has been verified.

A perusal of the Nominal Roll of the petitioner reveals that the petitioner was last granted parole w.e.f. 2nd March, 2018 for four weeks and he surrendered in time, there is no allegation that the petitioner misused the concession granted to him, though when he was earlier granted parole on 18th May, 2018 he jumped the parole and could be re-arrested only on 19th September, 2017.

Considering that on the last parole the petitioner had surrendered and that his father has passed away, this Court deems it fit to grant parole to the petitioner.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court.

Petition is disposed of.
