O R D E R

% 02.11.2018 Pursuant to the directions in the previous order, the petitioner (the complainant of the case under Section 138 of the Negotiable Instruments Act, 1881 pending before the trial court) has placed on record copy of the proceedings beginning with service of notice under Section 251 of the Code of Criminal Procedure, 1973 (Cr.P.C.) on the private party respondents, who are statedly the accused facing the prosecution, such proceedings having been held in July, 2014. Having regard to the proceedings which have been held thereafter, there is indeed a cause for grievance on account of delay. There is also a need for expedition on the part of all concerned including the parties, i.e. the petitioner and the accused and for better control over the proceedings by the presiding magistrate so that further delay does not occur. CRL.M.C. 3142/2018

At this stage, the counsel for the petitioner submitted that he may be permitted to withdraw the present petition and the application filed therewith as he would make appropriate prayer before the trial court for expeditious proceedings.

The petition and the application filed therewith stand dismissed as withdrawn.
