O R D E R
% 13.05.2016 This is a petition u/s 482 Cr.P.C. moved by the petitioner for quashing of FIR No.218/2015 registered at Police Station Sarita Vihar, Delhi under S. 135 of Indian Electricity Act and consequent proceedings emanating therefrom on the ground that the parties have compromised the matter.
It is submitted by counsel for the petitioner that the petitioner has already paid the amount of electricity bill to the respondent no.2 - BSES RPL towards civil liability and therefore, no purpose would be served by keeping the aforesaid alive and the proceedings arisen therefrom and the same be quashed.
Ms Jaya Thakura, Manager Legal of respondent No.2/complainant, is present in person and her statement has been recorded separately wherein she stated that the amount of bill has been cleared by the petitioner and department has no objection to the quashing of the FIR. Mr Mukesh Kumar, Additional Public Prosecutor for the State submits that in view of the settlement arrived at between the parties, he has no objection to quashing of FIR. Keeping in view the facts that the petitioner has already paid the amount of electricity bill and Manager Legal of R2-BSES RPL submits that the department has no objection to quashing of the instant FIR, this matter deserves to be given a quietus as continuance of proceedings arising out of the FIR in question would be an exercise in futility and wastage of precious time of the Court.
Accordingly, the petition is allowed and the FIR No.218/2015 registered at Police Station
Sarita Vihar, Delhi under S. 135 of Indian Electricity Act and consequent proceedings emanating therefrom are hereby quashed.
The petition stands disposed of accordingly.
