% 09.05.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 08th September, 2015 passed by a Coordinate Bench of this Court in W.P.(C) No.8188/2013, whereby the respondents were directed to determine whether any claims out of sum of Rs.10 lakhs had been made as yet or not and/or whether the possibility of any such claims being made in future remains and to pass a reasoned order within a period of nine months. In the petition it has been averred that despite the aforesaid order, the respondents have neither passed any reasoned order nor issued any notice to the petitioner till date or refunded the amount of Rs.10 lakhs to the petitioner.

Today, learned counsel for the respondents, who appears on advance notice, has handed over a copy of an order dated 01st May,

2017, whereby the competent authority after forfeiting Rs.1 lakh from the bank guarantee has directed release of the balance amount of Rs.9 lakhs to the petitioner upon fulfilling certain formalities. A copy of the said order is taken on record.

In view thereof, present contempt petition is closed. However, the petitioner is given liberty to challenge the order dated 01st May, 2017 - if it is aggrieved by the same - in accordance with law. The rights and contentions of all the parties are left open. MANMOHAN, J MAY 09, 2017 KA
