% 04.06.2018 Crl.M.A. 11327/2018 (Early Hearing) For the reasons mentioned in the application, the application is allowed.

W.P.(CRL) 1737/2018 The present application has been filed seeking parole for a period of one month.

The petition was filed on 28.05.2017.

The status report was called.

Status/verification report shows that examinations are to start on 04.06.2018 and to be finished on 21.06.2018.

Earlier, the matter came up before this Court on 12.12.2017 whereby the parole for three months was sought on the ground of social work practical to be undertaken under the guidance and supervision of the appointed Field Expert.

The petitioner was undergoing the sentence of rigorous imprisonment for seven years, of

which 5 years and about 8 months had already been undergone by him, and he was accordingly granted parole for a period of three months.

The petitioner surrendered on 25.05.2018 and then the present application was moved. It was well within the knowledge of the petitioner that the examinations in question were to be taken place in the month of June, 2018 at the time of submitting the examination form. It has been further submitted by the counsel for the petitioner that one paper has already taken place today in which the petitioner could not appear.

In the facts and circumstances, this Court is of the considered opinion that it would be appropriate and justified if the petitioner is permitted to undertake the examination in custody.

The Superintendent Jail is directed to take the petitioner in custody as per the date sheet filed along with the petition and make appropriate arrangement for the same.

The date sheet filed in the Court be attached along with the order passed by this Court. The present petition is accordingly disposed of. P.S.TEJI, J JUNE 04, 2018 dd
