% 16.05.2016 This is a petition under S. 482 Cr.PC moved by the petitioner for quashing of FIR No.0170/2016 registered at Police Station Kalkani, New Delhi under Ss. 308/506/323/324/34 IPC and consequent proceedings emanating therefrom on the ground that the parties have compromised the matter.

Notice.

Mr Panna Lal Sharma, Additional Public Prosecutor for the State/R1 accepts notice and at the outset objects to the quashing of the FIR on the ground that as per the FIR itself, there is one more accused namely Rajan but he has not been impleaded in this petition as a petitioner. Furthermore, proceedings under S. 82 Cr.PC have already been initiated against the petitioner. There are allegations of slapping the wife of complainant namely Mamta, who also levelled allegations of molestation against the petitioners, has not been impleaded as a party respondent in this petition.

On this, learned counsel for the petitioner, on instructions, seeks to withdraw the petition with liberty move appropriate petition.

In view of these submissions, the petition is dismissed as withdrawn with liberty as prayed for.
