File taken up today on office note for dismissal of the suit for non-prosecution.

I have examined the office note. It reflects that the suit was filed on 16.08.2014 by the plaintiff. Certain objections were raised by the office. The plaintiff or the counsel, however, did not appear to remove objections within the prescribed period of 30 days. In the instant case, the suit is lying under objection since 19.08.2014. In terms of Rule 5(1) and (2), Part-A(a), Chapter-I, Volume - V, Delhi High Court Rules, Practice and Procedure, objections are required to be removed within 30 days. The objections have not been removed till date.

It appears that the plaintiff is not interested in the prosecution of the suit. It is dismissed for non-prosecution. S.P.GARG, J.
