Vide the present execution petition, the decree holder(DH) is seeking enforcement of award dated 27.04.2007, in which the learned Arbitrator has determined the rate of Rs.382/- per cubic meter be paid by the judgment debtor(JD), but the issue regarding the actual quantity of work done by the DH is still pending adjudication before the Arbitrator and, therefore, the amount sought to be claimed by the decree holder is yet to be quantified.

After some arguments, learned counsel for the DH does not press the present petition but seeks liberty to approach the Court again after the quantity of work done by the DH is finally determined by the Arbitrator.

The petition stands dismissed as not pressed with liberty as prayed for.
