O R D E R

Appellant has filed an appeal for reduction of the award dated 20.07.2013 passed by the learned MACT awarding compensation of Rs.7,89,205/- along with interest @ 7.5% p.a. from the date of filing of the claim petition. The appellant deposited the entire awarded amount along with up-to-date interest with the Registrar General of this Hon'ble Court and 80% of the awarded amount was already directed to be released to the claimant in terms of award of the Tribunal.

We have interacted with the learned counsel/parties concerned. Apropos such interaction and deliberation, learned counsel for the appellant wishes to withdraw the present appeal to which learned counsel for the respondent has no objection.

amount was already directed to be released to the claimant in terms of the order of the learned Tribunal and also the fact that the accident in question has taken place in the year 2011, therefore, keeping in mind the exigencies and compelling reason, we direct the registry that the balance amount may also be released in favour of respondent (s)/claimant (s), subject to verification and completion of requisite formalities.

Needless to say that the appellant shall be entitled to refund of the statutory amount along with interest, if any. 5.

In terms of the aforesaid, the present appeal along with pending application (s) stand disposed of.

A copy of this order be sent to the concerned learned Tribunal with LCR, if already received.
