The petitioner is seeking the expeditious hearing and disposal of the petition for dissolution of marriage filed by her against the respondent on the ground of cruelty under Section 13(1)(ia) of the Hindu Marriage Act, 1955. It is submitted that the proceedings before the learned Family Court are listed on 01st August, 2018.

It is submitted that the respondent appeared before the Mediation Centre, Saket Courts on 26th August, 2017 and agreed to dissolve the marriage by mutual consent. The terms of the settlement were recorded before the mediation on 26th August, 2017, copy whereof is on record as Annexure P3 at page 42. It is submitted that the respondent did not honour the settlement and stopped appearing in the proceedings under DV Act. 3.
The petition is allowed and the learned Family Court is directed to expedite the hearing and disposal of the petition for dissolution of the
marriage.
