W.P.(C) 6116/2018 The present petition has been filed by the petitioner with the following prayers:

"In the facts and circumstances mentioned herein above, the petitioner most humbly prays that this Hon'ble Court may most graciously be pleased to:

a.

Issue a writ order of direction in the nature of certiorari or any other writ thereby restraining the respondent to issue fresh tenders (NIT) in the end of May, 2018- June, 2018 with respect to the Parking sites at Sukha Ped and Truck Parking Mori Gate.

b.

Issue a writ order or direction in the nature of mandamus or any other writ directing the respondent

corporation to issue the offer letter / letter of possession and hand over the physical possession of the Parking Site at Sukha Ped listed at Item No. 17 and Bus Parking Mori Gate listed at Item No.18, to the petitioner in terms of LOI (Letter of Intent) dated 09.02.2017 being ADC/RP CELL/NDMC/2017/D-2811 AND ADC/RP CELL / NDMC/2017/D-2812 after issuing necessary clarification regarding the status of DMRC with respect to the said parking sites;

c.

pass any other order / orders which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

Ms.Mini Pushkarna, Standing Counsel for the respondent states that the apprehension of the petitioner that the respondent are in the process of re-tendering, is without any basis. She states, as per her instructions, no fresh tenders are being issued for parking lots situated at Sukha Ped and Bus parking Mori Gate, for which, the petitioner has been issued LOI. She also states that the LOI issued to the petitioner on February 9, 2017, has not been withdrawn.

In view of the submission made, Mr. Uppal, learned Senior Counsel appearing for the petitioner states, the petition be disposed of as such. Ordered accordingly.

CM No.23742/2018 Dismissed as infructuous.
