% 30.05.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent nos. 2 to 4 are present in Court and accept notice. They have been identified by SI Karamvir of police station Narela.
Present FIR No. 780/2016 under Sections 307 IPC has been registered at police station Narela on the complaint of respondent no.2, who had sustained injuries in the incident. It is submitted that matter has been amicably settled between the petitioner and respondent nos. 2 to 4, therefore, aforesaid FIR may be quashed.
It is further submitted that a cross FIR No. 782/2016 under Sections 323/451/506/34 IPC was registered at police station Narela against the
respondent nos. 2 to 4 on the complaint of Satbir Singh (brother of petitioner). The said FIR has already been permitted to be compounded by the trial court and respondent nos. 2 to 4 have been acquitted. Learned APP has opposed the quashing of present FIR on the ground that respondent no.2 had sustained grievous injuries in the incident. However, in the facts of the present case where even cross FIR was registered and that settlement has been arrived at the initial stages, I am of the view that interest of justice demands that criminal proceedings are closed. Keeping in mind the settlement arrived at between the petitioner and respondent nos. 2 to 4 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
