The applicant/petitioner in the above captioned petition had deposited a sum of `1.5 lakhs with the Registry of this Court, pending the hearing of the appeal before the Cyber Appellate Tribunal (now the Telecom Disputes and Settlement Appellate Tribunal). The applicant states that the applicant had prevailed in the said appeal and the order has been set aside. The matter has been remanded to the Adjudicating Authority to consider afresh. 2.

There is no controversy as to the solvency of the applicant to pay the aforesaid amount, if the respondent prevails before the Adjudicating Authority.

In this view, the Registry of this Court is directed to return the sum of ₹1.5 lakhs deposited by the applicant before this Court alongwith accrued interest, thereon.

The application is disposed of.
