IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 6167/2018 & CM No. 23842/2018 YUDHVIR SINGH AND ANR.

..... Petitioners Through:

Mr Sandeep Vishnu, Advocate.

versus GOVT. OF NCT OF DELHI AND ORS.

..... Respondents Through:

Mr Dwapayan Gupta, Advocate for R-1.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 12.11.2018 1.

The petitioners (who are both senior citizens) have filed the present petition impugning orders dated 19.04.2018 and 27.04.2018 passed by the Deputy Commissioner, District North West rejecting their application seeking eviction of respondent nos.2 and 3 from the property bearing no.C9/268, Sector-7, Rohini, Delhi-110085. It appears from the averments made in the present petition that it is difficult for the petitioners and respondent nos.2 and 3 to live together.

Nonetheless, this Court is refraining from entertaining the present petition as the petitioners have an alternative remedy of approaching the Divisional Commissioner under the provisions of Rule 22(3)(4) of the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules 2009 as amended from time to time. 2.

It is directed that in case such an appeal is filed by the petitioners within a period of two weeks from today, the Divisional Commissioner shall

examine the same uninfluenced by question of any delay and dispose of the same within a period of four weeks, thereafter. 3.

The petition is disposed of with the aforesaid observations. 4.
