% 16.02.2017 IA 2070/2017 (for withdrawal of suit) and IA 2071/2017 (Exemption), both under Sections 151 CPC by the plaintiff Heard. Exemption from filing certified copy of the annexures is granted.

By the application (IA 2070/2017), the plaintiff states that the matter has been amicably resolved by the parties in terms of settlement agreement dated 31.03.2016, copy whereof has been submitted as Annexure A-1.

The counsel for the plaintiff acknowledges that the defendant has handed over to him through counsel, a demand draft bearing no.501865 dated 09.02.2017 drawn on ICICI Bank in the sum of Rs.60 Lakh in favour of the plaintiff in terms of the settlement agreement, in which view the plaintiff does not seek to prosecute the case further and seeks permission to withdraw it. Copy of the demand draft handed over, as submitted, is taken on record. The prayer made in the application is granted. The suit is dismissed as withdrawn. CS(OS) 1977/2010
