% 01.05.2017 During the course of hearing, learned senior counsel for the petitioner submits that appeal, as envisaged under Section 115 of the New Delhi Municipal Council Act, 1994 would be preferred by the petitioner within four weeks. She seeks leave to withdraw the petition. Writ petition is disposed of as withdrawn. In case appeal is filed by the petitioner within four weeks, the same shall be considered by the Appellate Tribunal without going into the question of limitation. As regards deposit of tax is concerned, petitioner will be at liberty to deposit the tax for the base year, that is, 2003-04 and 2005-06, since petitioner does not wish to challange the impugned order with regard to the
assessment year 2011 onwards, in view of the pendency of W.P. (C) 1985/2010. Miscellaneous application is disposed of as infructuous. Dasti.
