Since short point is involved in the present petition I intend to dispose of the same. Petitioner filed an application for exemption from personal appearance before the trial court on the medical ground, which has been rejected by the trial court. He had annexed OPD card along with the application. It is submitted that petitioner is not a resident of Delhi. In fact, he is a permanent resident of Raebareli, U.P. OPD card, annexed with the application, is of Rana Beni Madhav Zila Chikatsalay, Raebareli, an U.P. Govt. Hospital.

It is further submitted that petitioner had been regularly appearing before the trial court and on 25th May, 2018 he could not appear due to illness for which medical document was also annexed.

It is

assured that petitioner will appear before the trial court on the next date of hearing and will not seek unnecessary exemptions from personal appearance in future.

Keeping in view the assurance given by the petitioner that he will appear before the trial court on the date fixed and shall not seek unnecessary exemptions from personal appearance, impugned order qua the petitioner only is set aside and NBWs are recalled.

Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
