Plaintiff appears in person. Plaintiff states that he would like to convert the suit into a writ petition inasmuch as both the suit and the writ petition have to be filed in this Court. It is stated that on so doing plaintiff will be saved from paying court fee with respect to the reliefs claimed in the suit.

Considering that plaintiff is not a person with a legal background, the prayer of the plaintiff is accepted and the plaint be returned to the plaintiff alongwith court fee so that the same can be re-filed after making the necessary amendments as a writ petition in the Court. Since the suit plaint is returned, court fee also be returned to the plaintiff and plaintiff CS(OS) No.291/2016
will be entitled to seek refund of the court fee in the suit but plaintiff will have to pay the necessary court fee as payable by a petitioner in a writ petition.

Suit plaint is accordingly returned back to the plaintiff in view of and subject to aforesaid observations.
