O R D E R

% 31.05.2018 Vide the present petition, the petitioner has sought a direction restraining the respondent nos.2 & 3 from demolishing and dispossessing him from his property situated in Khasra Nos.1338(min) (2-15), 1344 (min) (1-18), 1345 (min)(1-0) and 1346 (min) (7-2) in Village Asola, New Delhi. The petitioner also seeks a direction to respondent nos.1 & 2 to demarcate the aforesaid property of the petitioner.

Ms.Hetu Arora, who appears on behalf of the respondents on advance notice, submits that the respondents have already carried out the requisite demarcation. Learned counsel for the petitioner, vehemently, disputes the same and contends that the said demarcation is incorrect. He places reliance on an order dated 7th May, 2018 passed by a Co-ordinate Bench in WP (C) No.4892/2018 and prays for similar directions.

Having considered the directions given by the Co-ordinate Bench and considered the prayers made in the present petition, I am of the view that the respondents are directed to treat the present writ petition as a representation and pass a reasoned and speaking order on the same after giving due opportunity of hearing to the petitioner. It is further directed that till the petitioner‟s representation is decided by the respondents, no coercive action will be taken against the petitioner.

Needless to say, in case the petitioner is aggrieved by any order passed by the respondent on his representation, he will be entitled to take legal recourse as permissible under law. The writ petition and pending applications are disposed of in the aforesaid terms.
