W.P.(C) 6419/2018 & C.M. No. 24654/2018 Vide the present petition, the petitioner has impugned the order dated 19th May, 2018 vide which, the petitioner-school has been directed to forthwith replace Sh. Sanjay Upadhyaya from the post of Manager and appoint a suitable person who is qualified as per the criteria prescribed in the circular dated 24th November, 2004.

After some arguments, learned counsel for the petitioner submits that in view of the fact that the said Manager is an experienced person and is

well-conversant with the administration of petitioner/school, he has instructions to state that the petitioner will not press the present petition, if the respondents grant them six months time to replace Mr.Sanjay Upadhyaya as a Manager by appointing a person who meets the criteria prescribed in the circular dated 24th November, 2004. Mr. Gautam Narayan, Advocate, who appears on advance notice, on instructions, fairly submits that in the peculiar facts of the present case the respondents, will not have any objection to the aforesaid request Accordingly, in view of the statement made by learned counsel for the respondents, while dismissing the writ petition as not pressed, the petitioner is granted six months time to comply with the order dated 19th May, 2018. The writ petition is disposed of in view of the aforesaid terms. REKHA PALLI, J.
