O R D E R

% 25.08.2017 Perusal of the order dated 8th February 2017 reveals that the appellant was in talks of settlement with the respondent No. 1/Bank and a proposal had been furnished to the respondent, which was under active consideration. On that, counsel for respondent No.1 confirmed that the proposal for settlement was only oral. Thereafter, this court recorded that if the appellant is serious about negotiating a settlement with the respondent No. 1/Bank, then he shall submit a written proposal to the bank within two weeks, which shall be duly considered and decision taken thereon and the appellant was directed to report the settlement, if any.

The matter again came up before this court on 27th April 2017, when nobody appeared on behalf of the parties and the matter was adjourned for today.

Mr. Varun Sharma, Advocate for respondent No. 1 appears and

informs that the matter has been settled between the parties. Apparently, the appellant is not appearing and it seems that he is not interested in pursuing the present appeal. Accordingly, the appeal filed by the appellant is dismissed in default.
