% 16.05.2016 Present writ petition has been filed challenging the order dated 06th May, 2016 whereby the respondent No.2 has directed the respondent No.3 to relocate the liquor vend of the petitioner from 4/5B, Asaf Ali Road, Delhi, to another suitable location in furtherance of the report of the Excise Inspector and Police authority.

Learned counsel for petitioner states that only 150 metres away from the petitioner‟s liquor vend, a private liquor vend is situated. He states that petitioner is being unfairly targeted by the Deputy Commissioner of Police of the area as well as by the Assistant Commissioner, Excise.

Learned counsel for respondent No.3-DTTDC supports the contention advanced by the learned counsel for petitioner. However, learned counsel for respondents No.1 and 2 points out that petitioner has made a representation dated 10th May, 2016 against the impugned order itself. He points out that the Deputy Commissioner has already fixed the matter for hearing on 19th May, 2016. In view thereof, present writ petition and application are disposed of with a direction to the Deputy Commissioner to decide the petitioner‟s representation within a period of one week. Before deciding the said representation, the Deputy Commissioner is also directed to visit the area in question.

This Court clarifies that it has not expressed any opinion on the merits of the controversy. Rights and contentions of all the parties are left open. Order dasti under the signature of Court Master. MANMOHAN, J MAY 16, 2016 js
