O R D E R

% 04.07.2018 The petitioner is facing criminal prosecution in the court of Special Judge for the offences punishable under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the gravamen being that he was found in possession of 300 gms. of heroin (commercial quantity). The petitioner prays for release on interim bail on the ground there is a process of demarcation exercise having been undertaken by the revenue authorities in his native village Kadrabad, Tehsil Dhanaura, District Amroha, U.P. in which his presence is necessary as it would lead to Chakbandi. The status report dated 02.07.2018 submitted by the investigating agency indicates a report of the revenue authority showing that the demarcation exercise for chakbandi has already been concluded. The counsel for the petitioner submits that the presence of the petitioner is still required at the native village as he may have to file objections. BAIL APPLN. 1313/2018

This court does not find any merit in the above plea, inasmuch as filing of objections is an exercise which can always be taken through a representative. Given the nature of the charges against the petitioner, prayer for interim bail is declined.

Dismissed.

This disposes pending application also.
