Vide the present petition, the petitioners seek to set aside the complaint bearing CC No.62/1 titled 'ITC Maurya Sheraton Employees Cooperative Thrift & Credit Society Ltd. Vs. Ranvir Singh Bhandari & Ors.' 2.

It is not in dispute that the aforesaid complaint was filed on behalf of the respondent No.1 for the offences punishable under Sections

405/406/120-B/34 IPC, wherein vide order dated 04.02.2013 summons were issued against the petitioners.

Learned senior counsel appearing on behalf of the respondent No.1, on instructions of Mr. Manjit Sudan, Secretary of respondent No.1, who is present in Court, submits that the respondent No.1 has decided to withdraw the aforesaid case and steps will be taken on the next date of hearing accordingly.

Accordingly, it is clarified that observations made qua the petitioner being office bearer of the respondent No.1 in order dated 04.02.2013 will have no consequence.

In view of the above, the present petition is disposed of. 6.

I hereby make it clear that if the petitioners are still aggrieved with the order passed by the learned Trial Court, they may approach this Court. SURESH KAIT, J.
