Notice was issued in the petition on the grievance of the petitioners which was articulated and noted in the order passed on 26.5.2016. It is stated therein that every Surveyor and Loss Assessor shall be eligible to perform such duties only if he is a member of Indian Institute of Insurance Surveyors and Loss Assessors.
1.1) This requirement according to the petitioners arises out of the notification dated 10.4.2015 issued by the respondent - IRDAI. 2.
Accordingly, on 26.5.2016, the impugned notification dated 10.4.2015 was stayed.

Since then, there has been some movement in the matter. Mr. Dipak K. Nag has brought to court a subsequent circular dated 7.9.2016. As a matter of fact, this aspect of the matter was brought to the notice of this court even on 6.12.2016. Based on this circular, Mr. Nag says nothing survives in the petition as the grievance of the petitioners has been taken care of via circular dated 7.9.2016.

Accordingly, as is evident, time was granted to the petitioners on 6.12.2016 to take instructions in the matter. 4) Mr. Yoginder Handoo, has returned with instructions, learned counsel says having regard to the submissions of Mr. Dipak K. Nag that the grievance of the petitioners has been taken care of by virtue of circular dated 7.9.2016, he does not want to press this petition further. 5) The writ petition and pending applications are, accordingly, disposed of.
6) It is made clear that if any grievance arises out of the circular dated 7.9.2016, the petitioners would be at liberty to take recourse to an appropriate remedy, albeit, in accordance with law. RAJIV SHAKDHER, J FEBRUARY 08, 2018 mk W.P.(C) 4908/2016
