O R D E R

% 23.01.2017 Learned counsel appearing for the petitioner on instructions from the petitioner submits that the petitioner would be willing to settle the matter and vacate the tenanted premises if time is given till 31.10.2017. He submits that the petitioner will file an undertaking in the form of an affidavit of the petitioner undertaking to vacate the tenanted premises on or before 31.10.2017. He will also give an undertaking in the affidavit to pay the agreed rent of Rs.900/- per month including arrears of rent. The arrears shall be paid within three months from today whereas the monthly rent shall be paid by the 7th day of each month. The petitioner shall also pay the electricity and water dues of the rented premises for the period under occupation. The petitioner shall also give an undertaking not to part with possession of the tenanted premises or wilfully damage the same. Learned counsel appearing for the respondent submits that subject to the petitioner filing the above undertaking, the respondent shall not execute the eviction order till 31.10.2017.

In view of the above, learned counsel appearing for the petitioner submits that he does not press the present Revision Petition. Petition stands disposed of in the above terms. The affidavit will be filed within four weeks from today. Once affidavit is filed the undertaking shall be taken on record. All pending applications, if any, also stand disposed of.
