The petition has been filed impugning the order dated 22nd February, 2016 confirming the conviction of the petitioner in CC No.7281/2014 under Section 138 of the NI Act. The petitioner was convicted by order of the MM on 25th May, 2015 against which the appeal was filed which was dismissed by the impugned order passed by the District and Sessions Judge, West, Tis Hazari Courts, Delhi.

The impugned order traverses through the contentions of the petitioner and notes that the petitioner admitted to the notice under Section 251 Cr.P.C. that he had issued the cheque against the loan granted by the complainant; as also in the statement recorded under Section 313 Cr.P.C. he admitted that he took the friendly loan of Rs.1,30,000/- from the complainant for a period of three months. In these circumstances, the Appellate Court dismissed the appeal.

In these facts and circumstances, this Court does not see any infirmity or illegality in the impugned order.
