% 01.06.2018 The petitioner claims to be aggrieved by the rejection of its technical bid. Reliance is placed upon certain e-mails and communications made to the respondents. The tender/NIT was in respect of operation and maintenance of RO STP and ETP Plant at Mundka Depot and Mundka Staff Quarters of the Delhi Metro Rail Corporation (DMRC). The approximate cost of the works is `107 lakhs. The petitioner claims to be manufacturer and service provider under the MSME category in the waste treatment and disposal field. Ms. Vibha Mahajan Seth, learned counsel for the DMRC, appearing on advance notice, submits that the petitioner's bid has not yet been rejected, contrary to the averments. It is stated that all concerned bids are at the stage of evaluation and appropriate

communication in this regard would be made to all concerned parties. It is, therefore, submitted that the petitioner has approached this Court at a premature stage and that in the event the petitioner has a grievance at a later stage, it is open to it to seek legal remedies. In the light of the submissions made, especially as yet there is no final tender evaluation and in any case, the petitioner's bid has not been rejected, the Court is of the opinion that the occasion to entertain this petition does not arise. It is open to the petitioner to agitate any future course of action, if the occasion so warrants. The petition is accordingly disposed of.
