% 23.02.2016 I.A. No.2558/2016 (u/o XXIII R.3 CPC) & O.M.P. No.1145/2014 The petitioner filed the abovementioned petition under Section 34 of the Arbitration and Conciliation Act, 1996 for setting-aside the Arbitral Award dated 22nd May, 2014.
During the pendency of the petition, the parties have resolved their disputes.
Therefore, the present joint application under Order XXIII Rule 3 read with Section 151 CPC has been filed by the parties. The same is duly signed by the parties as well as their respective counsel. It is also supported by the affidavits of the parties.
Along with the application, copy of the Settlement Agreement dated 8th February, 2016 entered into between the parties has been filed. The terms and conditions of the settlement are mentioned in the said Settlement
Agreement which is also signed by the parties as well as witnesses thereto. The parties shall be bound by the terms and conditions of the settlement. In view of the settlement, the present petition is accordingly disposed of.
