% 08.03.2019 There is no appearance on behalf of the petitioner. Even on the last date of hearing, there was no appearance on their behalf. Learned counsel appearing for respondent No.2-DDA submits that counter affidavit is ready and the same would be filed in the Registry during the course of the day. Learned counsel submits that the matter has recently been assigned to him and makes an oral prayer for waiver of cost imposed vide order dated 10.12.2018. For the reasons stated at the bar, the cost imposed vide order dated 10.12.2018 is waved. Let respondent No.2 file the counter affidavit within two days with advance copy to the learned counsel for the petitioners, who may file rejoinder thereto, if any, before the next date.

Counter affidavit has also not been filed by respondent No.1 and there is no appearance on their behalf either. Accordingly, the right of respondent No.1 to file the counter affidavit is closed. Re-notify on 09.05.2019.
